Back when I still read PC Mag, I considered him one of the most 
intelligent columnists/commentators in the industry.

That is, of course, damning with faint praise, but still. :-)

I'm not that concerned about the courts going ape and shutting Linux 
down.  That's highly unlikely.  What I AM worried about is PHBs seeing 
this and turning right back around to Microsoft, because "at least that 
rug won't be sued out from under us."

 From a philisophical standpoint, this case is probably the best 
argument in favor of Open Source ever.  (This whole thing is nonsense, 
go GNU!)  From a pragmatic standpoint, it could be a huge PR disaster 
for FS/OSS, even if we win in court.
